Acceptance of Terms

By subscribing to or using Pocket Concierge, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our service.

Description of Service

Pocket Concierge provides personal concierge services via WhatsApp, including but not limited to restaurant reservations, travel arrangements, activities planning, and general inquiries ("Service").

Subscription and Payment

Subscription Plans

• Our current subscription fee is AED99 per month for our standard plan.
• We may offer additional premium plans at different price points.
• All fees are exclusive of applicable taxes.

Payment and Billing

• You agree to pay all fees associated with your subscription.
• Payments are charged on a recurring monthly basis.
• You authorize us to charge your payment method for all fees incurred.
• All payments are non-refundable except as expressly stated in these Terms.

Cancellation

• You may cancel your subscription at any time.
• Cancellation will be effective at the end of your current billing period.
• No refunds will be provided for partial month subscriptions.

Service Limitations

Request Handling

• We strive to fulfill all reasonable requests but cannot guarantee that all requests will be fulfilled.
• Response times may vary depending on the complexity of the request and time of day.
• Certain requests may incur additional third-party costs, which will be communicated to you for approval before proceeding.

Service Hours

• While we aim to provide prompt assistance, standard response times are within business hours.
• Emergency requests outside of business hours will be handled on a best-effort basis.

Third-Party Services

• Many of our services involve booking or arranging services provided by third parties.
• We are not responsible for the quality, safety, or reliability of third-party services.

User Responsibilities

You agree to:

• Provide accurate and complete information
• Maintain the confidentiality of your account
• Use the Service in compliance with all applicable laws
• Respond to communications from your concierge in a timely manner
• Treat our staff with respect and professional courtesy

You agree not to use our Service for:

• Illegal activities
• Harassment or abuse
• Activities that may cause harm to others
• Requests that are unreasonable, impractical, or unethical

Data Usage and Analytics

By using our Service, you grant Pocket Concierge the right to:

• Collect, store, and process your personal information and service usage data
• Analyze your preferences, requests, and interactions to improve our services
• Use anonymized and aggregated data for business intelligence purposes
• Develop new features and offerings based on user behavior and preferences
• Train our team members and systems to better serve your needs and preferences
• Use artificial intelligence and machine learning algorithms to analyze data patterns

We may retain and use your data even after your subscription has ended, in an anonymized format, for service improvement and business intelligence purposes.

Your data will always be handled in accordance with our Privacy Policy and applicable data protection laws in the UAE.

Intellectual Property

All content, features, and functionality of our Service are owned by Pocket Concierge and are protected by copyright, trademark, and other intellectual property laws.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

IN NO EVENT SHALL POCKET CONCIERGE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

Indemnification

You agree to indemnify and hold Pocket Concierge harmless from any claims, losses, liability, damages, and/or costs including reasonable attorney fees arising from your use of the Service, violation of these Terms, or violation of any rights of another.

Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service at any time without notice. We may also revise these Terms from time to time. The most current version will always be posted on our website.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration conducted in Dubai, UAE in accordance with the rules of the Dubai International Arbitration Centre (DIAC).

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
